Terms of Service

These Terms of Service (the "Terms") govern your use of the Orusta mobile application and its related services (the "Services"), published by Challenge Arena Software FZCO, a free zone company registered under licence no. 80218 with the Dubai Integrated Economic Zones Authority (DIEZA), IFZA Properties, DSO-IFZA, Dubai Silicon Oasis, Dubai, United Arab Emirates ("we", "Orusta").
By creating an account or using the Services, you accept these Terms without reservation. If you do not accept them, do not use the Services.
1. Purpose of the service
Orusta is a social fitness application that allows you to take part in video challenges, to face other users in live battles, to compete in a ranked mode, to follow workouts, to join a community and clubs, and to access gamification features (XP, levels, leaderboards) as well as an optional shop and subscriptions.
2. Acceptance and amendment of the Terms
By using the Services, you acknowledge that you have read and accepted these Terms. We may amend them; in the event of a substantial change, you will be informed through the app or by email, with reasonable notice where the law requires it. Continuing to use the Services after the changes take effect constitutes acceptance of the amended Terms. The version in force is always available in the app and at https://orusta.com/en/terms.
3. Eligibility and account
- You must be 16 or over to create an account. This floor is the maximum that Article 8 of the GDPR allows a Member State to set: since no State in the European Economic Area requires parental agreement above 16, none is asked for.
- You undertake to provide accurate information and to keep it up to date.
- You are responsible for keeping your credentials confidential and for any activity carried out from your account.
- One account per person. Creating multiple accounts, in particular in order to circumvent a sanction or to manipulate the leaderboards, is prohibited.
4. Rules of conduct
You undertake not to:
- publish or transmit content that is unlawful, abusive, defamatory, hateful, discriminatory, pornographic or violent;
- harass, intimidate or threaten other users;
- impersonate any person or entity;
- exploit or attempt to exploit technical vulnerabilities in the service;
- distribute spam or unsolicited advertising content;
- infringe the intellectual property rights of a third party.
These rules are set out in more detail in our Community Guidelines, which form an integral part of these Terms.
Two further documents complete these Terms and also form an integral part of them: the Contest Rules, which govern prize-bearing challenges (section 8), and the Privacy Policy, which describes how your data is processed (section 16).
5. Sporting integrity, ranked mode and anti-cheat
Orusta rests on trust in the reality of athletic performance. Any attempt to falsify a performance or a leaderboard position constitutes a serious breach of these Terms.
The following are prohibited in particular:
- the use of pre-recorded or replayed videos, or of videos originating from other sources;
- simulated movements intended to deceive the automatic counting of repetitions;
- the use of bots, scripts or automated tools;
- the creation of multiple accounts in order to manipulate the leaderboards or stake-based battles;
- any collusion between players aimed at falsifying a result.
Sanctions applicable to ranked mode and anti-cheat. Where cheating is established or strongly suspected, we may, depending on the seriousness:
- cancel scores, points, ranks or rewards obtained improperly;
- exclude the account from ranked mode temporarily or permanently;
- suspend or permanently ban the account from all of the Services.
Cheating signals are detected automatically, but any significant sanction (cancellation, exclusion from ranked, ban) is decided by our team, never by an algorithm alone. A ranked ban may be temporary or permanent. You can contest a decision by writing to legal@orusta.com (see also section 11).
6. Orusta VIP subscription, VIP Pass and purchases
Orusta offers three optional purchases, and three only: the Orusta VIP subscription, Carat packs, and activation of the VIP Pass.
- Orusta VIP. A monthly subscription that gives access, for as long as it is valid, to benefits within the application: unlimited Tickets, a permanent experience bonus, an allocation of Carats each month, and access to the VIP shop and its exclusive cosmetics. The exact details are presented in the app at the time of subscription.
- Carats. Carats are the only virtual currency sold for real money, in the form of one-off packs bought through the App Store or Google Play. Tickets and Coins are never sold (see sections 7 and 8).
- VIP Pass. A time-limited reward track, with a free track open to everyone and a premium track that you activate by spending Carats. The VIP Pass is a purchase separate from the Orusta VIP subscription: taking out the subscription does not activate the Pass, and activating the Pass does not grant the subscription's benefits.
- Billing. Subscriptions and purchases are made and billed through your App Store (Apple) or Google Play (Google) account, under their own terms. We never receive your payment card details.
- Auto-renewal. Unless stated otherwise, the subscription renews automatically for an identical period, at the price then in force, unless it is cancelled at least 24 hours before the end of the current period.
- Cancellation. You manage and cancel your subscription directly from your Apple or Google account settings. Cancellation takes effect at the end of the period already paid for; that period is not refunded on a pro rata basis, save where mandatory legal provisions require otherwise.
- Refunds. Requests for refunds of purchases made through the stores fall under the policies of Apple and Google, which handle them directly.
- Right of withdrawal (EEA consumers). You are in principle entitled to a right of withdrawal of 14 days on contracts concluded at a distance. This right is lost for digital content once its performance has begun with your prior express agreement and you have acknowledged losing that right (Article 16 of Directive 2011/83/EU). This is what the stores' purchase flow implements: by triggering immediate access to a subscription or to content, you consent to that immediate performance and waive the right of withdrawal for the part already supplied.
- Changes to prices and content. We may change prices (with prior notice and, where applicable, a right to cancel) as well as the content of our offers. No permanent availability of any benefit, item or season is guaranteed.
- Free trials. No free trial is offered as of today. If we introduce one, its duration will be indicated to you before you subscribe, and it will automatically turn into a paid subscription at the end of the trial period if you do not cancel before it ends.
7. Virtual currencies and items
The Services include virtual currencies (Tickets, Coins and Carats) as well as virtual items (cosmetics, emotes, etc.).
- These currencies and items are granted to you under a limited, personal and revocable licence to use them within Orusta. You do not own them.
- They have no monetary value, and can be neither exchanged for money, nor converted into cash, nor transferred outside your account, nor assigned to another user.
- Virtual currencies and items that have been acquired are non-refundable, save where mandatory legal provisions require otherwise.
- They may be lost if the account is closed or banned, without compensation.
- We may change, cap or withdraw currencies and items on legitimate grounds (balancing, security, end of availability), with prior notice in the event of a substantial change.
Randomised reward packs. The Services include packs whose contents are drawn at random from a defined set of rewards (virtual currencies, Tickets).
- The probability of each reward is displayed in the application, before opening, from the pack opening screen. It reflects the draw that is actually applied.
- Packs are not sold directly for real money. They are obtained by playing (daily reward, level-up, quests, events) or through the premium track of the VIP Pass, which is itself activated with Carats (section 6).
- Opening is final: the reward obtained is credited to your account and cannot be exchanged, redrawn or refunded.
- The rewards obtained remain virtual currencies and items within the meaning of this section, and therefore have no monetary value.
8. Stake-based battles
Some battles may be played with a stake in Coins, redistributed to the winner within the application. The stake is optional: a battle can be played without one.
This is not gambling. That classification conventionally requires three elements to be present together: a stake having a value, a predominant element of chance, and a prize of real value. None of the three is present:
- No purchasable stake. Stake-based battles are played exclusively in Coins, and Coins are never sold for real money: they are earned by playing. The only currencies and content sold are Carats, the Orusta VIP subscription and activation of the VIP Pass (section 6). For the sake of transparency: Coins may feature among the rewards of the VIP Pass premium track, which is itself activated with Carats. That route remains indirect, capped by progression, and without any influence on the outcome of a battle, which depends solely on athletic performance.
- No element of chance. The outcome depends on an athletic performance, and therefore on skill and effort, not on chance. This is the decisive element: even assuming a stake having a value, the absence of chance is on its own enough to rule the classification out.
- No prize of real value. Winnings are virtual currencies with no monetary value (section 7), not convertible into money and not withdrawable.
Prize-bearing challenges. Separately from the stake-based battles above, we may offer challenges rewarded with a real prize, on our own or with a partner. These challenges are contests of skill: the winner is determined by their measured athletic performance, with no draw. Entry is free and requires no purchase, and no purchase confers any advantage on the result. They are governed in full by the Contest Rules, available in the application from the page of the challenge concerned.
9. Content you publish
- You retain the intellectual property in the content you publish (videos, messages, etc.).
- By publishing content, you grant Orusta a non-exclusive, royalty-free, worldwide licence for the legal term of copyright, allowing it to be hosted, reproduced, displayed, distributed and adapted as part of the operation and the promotion of the Services.
- You represent that you hold the necessary rights in this content and warrant that it does not infringe any third-party rights.
- We may remove any content that breaches these Terms or the Community Guidelines. To report an infringement of your rights (in particular intellectual property rights), write to legal@orusta.com.
Special case of prize-bearing challenges. The Contest Rules frame the use of the winner's username and video more strictly: publication for the sole purpose of announcing the result, with any advertising use beyond that requiring a separate written agreement from the winner. For content submitted to a prize-bearing challenge, those Rules prevail over the promotional licence set out above.
10. Health warning
Orusta involves potentially intense physical activity. You take part at your own risk. We recommend that you consult a doctor before starting any new training programme. In the event of pain, discomfort or a pre-existing medical condition, stop immediately and consult a healthcare professional. The content and suggestions in the app do not constitute medical advice. To the extent permitted by law, Challenge Arena Software FZCO cannot be held liable for injuries resulting from use of the Services.
11. Moderation and sanctions
Where these Terms or the Community Guidelines are breached, we may, at our reasonable discretion and depending on the seriousness:
- issue a warning and remove the content in question;
- suspend the account temporarily;
- exclude the account from ranked mode (see section 5);
- permanently ban the account;
- take any appropriate legal action.
Moderation is triggered by a report or by automatic detection. Reports are handled as promptly as possible.
The share of automation, precisely. An automatic filter may refuse to publish a message containing prohibited terms: the message is then not sent, and you are told immediately. This is the only case where automated processing decides on its own, it concerns content that was never published, and it carries no account sanction.
By contrast, any decision to remove already published content and any account sanction (warning, suspension, exclusion from ranked mode, ban) are taken by a member of our team, never by an algorithm alone. You can contest them by writing to legal@orusta.com; they will be reviewed again with human intervention.
12. Orusta's intellectual property
The application, its code, its graphics, its logos, its trade marks, its databases and all of its components are the exclusive property of Challenge Arena Software FZCO or of its partners. Any unauthorised reproduction, representation or exploitation is prohibited.
13. Suspension and termination
- You can delete your account at any time from the app or via https://orusta.com/delete-account.
- We may suspend or terminate your access in the event of a serious or repeated breach of these Terms.
- Effects of termination. When the account is closed or banned, access to the Services ceases and virtual currencies and items are lost (section 7). Terminating your account does not automatically stop a subscription taken out through a store: that subscription must be cancelled from your Apple or Google account (section 6).
14. Service availability
The Services are provided "as is" and "as available". We may change, suspend or discontinue all or part of the features, in particular for reasons of maintenance, security or product development. We do not guarantee uninterrupted or error-free operation.
15. Limitation of liability
To the extent permitted by applicable law, Challenge Arena Software FZCO cannot be held liable for indirect, incidental or consequential damages resulting from the use of, or the inability to use, the Services.
What this limitation does not exclude. It does not apply, and cannot exclude our liability, in the event of wilful misconduct, gross negligence, or personal injury. Nor does it affect the mandatory consumer rights applicable in the European Economic Area (see section 17).
16. Personal data
The processing of your personal data is described in our Privacy Policy.
17. Governing law and jurisdiction
These Terms are governed by the law of the United Arab Emirates and the applicable DIEZA regulations. Any dispute falls in principle within the jurisdiction of the competent courts of Dubai.
Consumers in the European Economic Area. This choice of law cannot deprive you of the protection afforded to you by the mandatory provisions of the law of your country of habitual residence (the Rome I Regulation, Article 6). You also retain the right to bring proceedings before the courts of your country of residence. In other words, the clause above in no way reduces your mandatory consumer rights.
