Terms of Service

These Terms of Service (the "Terms") govern your use of the Orusta mobile application and related services (the "Services"), operated by Challenge Arena Software FZCO, a company registered under license no. 80218 with the International Free Zone Authority (IFZA), located at IFZA Business Park, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates ("we", "Orusta").
By creating an account or using the Services, you unconditionally accept these Terms.
1. Service purpose
Orusta is a social fitness mobile application that lets you participate in video challenges, face other users in live battles, join a sports community, and access gamification features (XP, levels, rankings).
2. Account creation
- You must be 13 years of age or older to create an account. Users residing in the European Economic Area and under 16 must obtain parental or legal guardian consent.
- You agree to provide accurate information and keep it up to date.
- You are responsible for maintaining the confidentiality of your credentials and for all activities conducted from your account.
- Only one account per person is allowed.
3. User conduct
You agree not to:
- post or transmit unlawful, abusive, defamatory, hateful, racist, sexist, pornographic, or violent content;
- harass, intimidate, or threaten other users;
- impersonate any person or entity;
- cheat in challenges or battles (pre-recorded videos, simulated movements, bots);
- exploit or attempt to exploit any technical flaws of the service;
- distribute spam or unsolicited promotional links;
- infringe any third party's intellectual property rights.

4. Health disclaimer
Orusta is a fitness app involving potentially intense physical activity. You acknowledge that you participate at your own risk. We strongly recommend consulting a doctor before starting any new training program. In case of pain, discomfort, or pre-existing medical conditions, stop immediately and consult a healthcare professional. Challenge Arena Software FZCO shall not be held liable for injuries, accidents, or health issues resulting from use of the service.
5. User-generated content
- You retain intellectual property rights to the content you post (videos, messages, etc.).
- By posting content, you grant Orusta a non-exclusive, royalty-free, worldwide license, valid for the legal duration of copyright, to reproduce, display, broadcast, and modify that content solely for the purpose of operating and promoting the service.
- You represent that you hold the necessary rights to the content you post and that it does not infringe any third party's rights.
- Orusta reserves the right to remove any content that violates these Terms or the Community Guidelines.
6. Moderation and sanctions
In case of violation of these Terms or the Community Guidelines, Orusta reserves the right, at its sole discretion and without notice, to:
- remove the content at issue;
- temporarily suspend your account;
- permanently ban your account;
- take any appropriate legal action.
Challenge video submissions are subject to human moderation before publication. Reports are processed within 24 hours whenever possible.
7. Personal data
The processing of your personal data is described in our Privacy Policy.
8. Orusta's intellectual property
The Orusta application, its source code, graphics, logos, trademarks, database, and all elements composing it are the exclusive property of Challenge Arena Software FZCO or its partners. Any unauthorized reproduction, representation, or exploitation is prohibited.
9. Termination
- You may delete your account at any time from within the app or via https://orusta.com/delete-account.
- We may suspend or terminate your access to the Services in case of serious or repeated violations of these Terms.
10. Limitation of liability
Orusta is provided "as is", without warranty of any kind. To the extent permitted by applicable law, Challenge Arena Software FZCO shall not be liable for any indirect, incidental, or consequential damages resulting from the use of or inability to use the service.
11. Changes to the Terms
We may modify these Terms. In case of substantial changes, you will be notified through the app or by email, and your renewed acceptance may be required.
12. Governing law and jurisdiction
These Terms are governed by the federal laws of the United Arab Emirates and by the applicable regulations of the International Free Zone Authority (IFZA). Any dispute relating to their interpretation or execution shall fall within the exclusive jurisdiction of the competent courts of Dubai, United Arab Emirates, subject to mandatory consumer protection rules applicable in other countries of residence.
